COMMISSION TERMS AND CONDITIONS

I, TAYLOR ZHIFU, the ARTIST, reserves complete copyright control over the commission in all aspects (sketches, in progress work, and the finished product), NOT the CLIENT. Therefore, I am permitted to promote myself with the work, publish and share it publicly (such as my website and social media). YOU, the CLIENT (the buyer/commissioner), is permitted to request and negotiate to share the commission publicly. YOU, the CLIENT, agree to use the commission for PERSONAL USE ONLY which means You are granted a CC BY-NC-ND license.

 

This means that You:

  • Must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use. 

  • May not use the material for commercial purposes.

  • May not distribute the modified material if you remix, transform, or build upon the material

  • ​

If YOU wish to commission a work for commercial use, a contract proposal from YOU is required. MY rate for commercial work is $80 USD per hour.

All commissions and other work from me you receive will feature a signature that you are NOT permitted to remove, obstruct, or obscure under ANY circumstances. 

 

PRICES

The prices listed or quoted for commissions are APPROXIMATE because I generally pay myself $25 USD per hour. I choose this method of payment in an effort to be fairer with pricing. For example, easier commissions to complete could result in a cheaper price, while complicated commissions will be more fairly compensated. The currency that I accept is the United States Dollar (USD). Upon payment you will receive an invoice via PayPal you will be required to contribute or complete.

 

PAYMENT

It is required that a minimum of 50% of the payment for the commission is paid to move forward past the sketch phase of the commission. After completing the project, it is required that the other 50%, equaling to 100% of the payment, is transferred before I send YOU the final result of the completed commission. I will send you the final product through YOUR platform of choice. If YOU do not choose one, I will send YOU a Google Drive link so the image will not be compressed. Other types of images of your commission are available upon request (e.g.: an image with only lineart).

DO NOT send payment of any kind before I have accepted and have agreed to YOUR commission request. Remember that I reserve the right to reject any commission request for any reason. Sending premature payment will NOT persuade me to agree to your commission request. Payments are completed through an invoice initiated by ME only.

 

PROCESS

While working on YOUR commission, I will provide sketches and check in with YOU as often as possible to make sure that I’m on the right track with what YOU are envisioning for the end product to look like. HOWEVER, because my policy states that payment is only required to go past the sketch phase, it is ultimately MY decision to determine if the sketch phase has gone on too long, and will require payment to continue.

I expect frequent feedback from YOU, the CLIENT, about each sketch and revision. If YOU, the CLIENT, have implemented a deadline for the commission, YOU agree that YOU are just as responsible as I am to complete the commission on time. I will NEVER move forward with revisions without YOUR explicit approval. 

The images I send to you with the purpose of reviewing will be of lower image quality to save time, memory/storage, and will come with a signature you are NOT permitted to remove, obstruct, or obscure.

Before proceeding past a sketch or revision, I will ask for YOUR approval. If a great amount of progress has been made and YOU want to change something that has been previously approved, please see REVISIONS.

If any circumstances in my personal life occur that will halt or prolong the progress of your commission I will let you know as soon as possible and ask that you please be understanding. If at that point you would want a refund, please see REFUNDS.

When the commission is finished, YOU will receive the full resolution image. This will be sent over the preferred method of contact according to the CLIENT. However, I am not responsible for automatic image compressions if the preferred contact method (such as Facebook) does not allow large images to be transferred on its platform. It is recommended that Dropbox or Google Drive is used to retain the full resolution of the image. 

 

REVISIONS

If something that was previously APPROVED by the CLIENT needs to be changed, there will be additional charges. How much the additional charges will be will depend on how much time the change will take to complete (e.g.: changing colors could take a half hour or so, and a pose change to a character could take several hours to rework). How I will calculate extra time to make changes to previously approved progress will simply be $38 USD per hour, which is known as overtime (time-and-a-half) pay in the United States. 

 

REFUNDS

YOU will be entitled to a 90% or lower refund depending on how much time has been spent before YOU have decided to cancel the commission. For example, if lineart has not been completed yet, YOU could be entitled to 80%, if the commission is nearly complete, YOU could be entitled 10% Ultimately, I will have the final say. If it was MY decision to terminate the commission, or the commission has to be terminated due to personal circumstances, YOU are entitled to a 90% refund regardless of progress on the commission.

DO NOT request a chargeback, I will refund YOU if YOU are eligible for one. If YOU have violated these TERMS AND CONDITIONS, You DO NOT deserve a refund. If you DO request a chargeback at any point in time, I will decline it and provide PayPal and your bank (if applicable) proof that I have done work for you, and that you have AGREED to these TERMS AND CONDITIONS. Furthermore, if you do request a chargeback, you will be blacklisted from commissioning me again.

COPYRIGHT INFRINGEMENT

You do NOT have my permission to use my work to make money. You are infringing my copyright if YOU use my work for monetary gain, use it commercially, or if YOUR actions violate the rights of the  CC BY-NC-ND license. If you commit copyright infringement you will be blacklisted from commissioning me again. I have the right to sue for COPYRIGHT INFRINGEMENT and send a CEASE AND DESIST letter.

 

ADDITIONAL

I have the right to record my process with video and/or still images. Whether I share the commission and its process publicly or not can be negotiated with the CLIENT, but it needs to be established before I start working as the default decision will be up to ME, the ARTIST.

KO-FI FLAT RATE COMMISSIONS TERMS AND CONDITIONS â€‹

If you commit copyright infringement you will be blacklisted from commissioning me again. I have the right to sue for COPYRIGHT INFRINGEMENT and send a CEASE AND DESIST letter.

ADDITIONAL INSTRUCTIONS FOR KO-FI FLAT RATE COMMISSIONS

Before you purchase a commission, please contact me (via Twitter, Instagram, or taylor.zhifu.artist@gmail.com) about what you would like to have done so I can see if it is something I can do. Have a solid idea of what you want done.

I'm open to NSFW, but only for certain things, which is another reason why I'd like to have a heads up about what you would like before you purchase.

All of the above will save us time if it turns out I can't do what you request of me, so I'd rather let you know if I can or can't do something before you purchase.


REGARDING ANIMAL CROSSING

Copyright law protects finished works of art. It does not protect things like facts, ideas, procedures, or an artist's style, no matter how distinct. Therefore, creating my own characters in their style does not infringe upon their copyright. If I have misinterpreted this law, please let me know and I will take down the content.

 

​SHOP

All shop items are copyrights that I own and are of my own finished original design. Therefore, they are copyrighted to me and anything that violates my copyright is considered Copyright Infringement
